Terms of Service

BossMode is a hosted software service for governed AI operations, analytics, approvals, audit trails, and related operator workflows. We may update the product, APIs, and integrations from time to time so long as we do not materially remove core subscribed functionality without notice.

You are responsible for your instructions, prompts, connected systems, human approvals, regulatory obligations, and the downstream effects of any action your team or agents take. You must keep access credentials secure and promptly notify us of suspected compromise.

As between the parties, you control the customer data submitted to BossMode and we process that data as your processor for the limited purpose of providing the service. The data processing terms at /dpa are incorporated by reference for customers subject to GDPR or similar laws.

You may not use BossMode to break the law, interfere with third-party systems, evade provider restrictions, or operate destructive automations without appropriate approvals. We may suspend access to protect the service, our infrastructure, or third parties if we reasonably believe there is abuse, fraud, or active security risk.

Subscription fees, payment timing, trials, renewals, and downgrades are described in your checkout flow, invoice, or order form. Past-due accounts may lose access until payment is resolved. Taxes are your responsibility except for taxes based on our net income. All fees already charged are final and non-refundable unless a signed agreement expressly overrides this policy or a non-waivable refund right is required by applicable law. Canceling a subscription stops future renewals; it does not create a refund, refund credit, or cash alternative for the current or past billing period. BossMode purchases are governed by the No-Refund & Dispute Policy, including the no-refund rule and chargeback evidence provisions.

When you provide your mobile number and opt in, the BossMode SMS Program may send text messages from +1 404-383-0061 or another BossMode sending number. Expected message types include requested AI demo access, appointment confirmations, reminders, service follow-up, support updates, and, only if you separately choose the marketing checkbox, special offers, discounts, and service updates.

The marketing SMS consent presented at opt-in is: “I consent to receive marketing text messages, about special offers, discounts, and service updates, from BOSSMODE (BossMode) at the phone number provided. Message frequency may vary. Message & data rates may apply. Text HELP for assistance, reply STOP to opt out.”

The non-marketing SMS consent presented at opt-in is: “I consent to receive non-marketing text messages from BOSSMODE (BossMode) about my requested AI demo access, appointment confirmations, reminders, and service follow-up. Message frequency may vary, message & data rates may apply. Text HELP for assistance, reply STOP to opt out.”

Message frequency may vary. Message and data rates may apply. Consent to receive SMS messages is optional and is not a condition of purchase. You can cancel the SMS service at any time by replying STOP. After you send STOP, BossMode may send a confirmation text, and you will no longer receive SMS messages unless you rejoin. To rejoin, sign up again through the original opt-in form or otherwise provide fresh consent.

For help, reply HELP to any BossMode text message or email support@bossmode.ing. Carriers are not liable for delayed or undelivered messages. The SMS Program is intended for users who are at least 18 years old or the age of majority in their jurisdiction. See the BossMode Privacy Policy for how mobile opt-in data and consent are handled.

Each party will protect the other party's confidential information using reasonable safeguards and may use that information only to perform under these terms. Confidential information does not include information that is public, independently developed, or rightfully received without confidentiality restrictions.

We warrant that BossMode will materially perform as described in our documentation. Except for that limited warranty, the service is provided “as is” and “as available,” and we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, even if advised of the possibility. Our aggregate liability for all claims arising out of or related to the service will not exceed the fees paid by you for BossMode in the twelve months before the event giving rise to the claim.

You will defend and indemnify us against third-party claims arising from your data, your use of the service in violation of law or these terms, or your connected systems and downstream automations. We will defend you against third-party claims that the core BossMode service infringes a patent, copyright, or trademark, subject to customary exclusions for your data, combinations, or modifications.

These terms continue until your subscription ends. Either party may terminate for material breach not cured within 30 days. On termination, access ends and we will handle customer data according to our Privacy Policy, retention commitments, and any verified deletion request.

Current subprocessors are listed at /subprocessors. Where required, we rely on standard contractual commitments and appropriate technical safeguards for international transfers.
